These Terms of Service ("Terms") govern your use of the KinLink mobile application and website (the "Service") provided by KinLink LLC ("KinLink," "we," "us," or "our"). By downloading, installing, or using KinLink, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create a Guardian account, and every Dependent must be at least 13 years old. A Dependent connection can only be created by a Guardian: the Guardian generates an invite code and PIN, and the Dependent enters them to pair. There is no Dependent self-signup. Creating a Dependent profile for a child under 13 is prohibited and grounds for termination.
For any Dependent who is a minor (13 to 17), the Guardian must be the Dependent's parent or legal guardian, or act with that person's express authorization. A Dependent profile is a managed profile within the Guardian's family record, comparable to a child account inside a family-sharing service; Section 14 describes what that means for account control and deletion. By using the Service, you represent that you meet the requirements for your role.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@kinlinkapp.com if you suspect unauthorized access. You agree to provide accurate information and keep it current.
KinLink provides a family safety platform including location sharing, geo-fence alerts (the "Places Mesh"), check-in requests, and related features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable prior notice except where required by law or in cases of security, fraud, or legal compliance.
You agree not to use the Service to:
You acknowledge that KinLink collects and uses location data as described in our Privacy Policy. As a Guardian, you represent that every Dependent whose profile you manage either (a) has personally consented to location collection and sharing with you, or (b) is a minor or a person for whom you hold legal authority to consent, and you consent on their behalf. You are responsible for ensuring your use of KinLink complies with all laws that apply to you, including laws governing the monitoring of minors and of adults in your care.
Private Places. The Service lets a Guardian mark a Place as private, meaning the Dependent receives alerts-relevant monitoring at that Place without the Place appearing in the Dependent's own app (see Privacy Policy Section 6). Guardians may use this feature only within the scope of the consent and legal authority described above. Using Private Places to monitor a person you have no authority over is a violation of Section 4.
By submitting check-in notes, photos, or other content through the Service, you grant KinLink a limited, non-exclusive, royalty-free license to store and transmit that content solely as necessary to provide the Service. You retain ownership of your content. You represent that your content does not violate any third-party rights and that you have all necessary rights to submit it.
KinLink is not a substitute for emergency services. The Service does not provide real-time emergency response, does not contact emergency services on your behalf, and should not be relied upon in life-threatening situations. Always contact 911 or your local emergency services directly in an emergency. Location data provided through KinLink may be delayed, inaccurate, or unavailable, and must not be relied upon for emergency response purposes.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOCATION DATA WILL BE ACCURATE OR TIMELY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINLINK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM INACCURATE LOCATION DATA, DELAYED OR MISSED NOTIFICATIONS, SERVICE UNAVAILABILITY, OR RELIANCE ON THE SERVICE IN AN EMERGENCY SITUATION, EVEN IF KINLINK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
You agree to indemnify, defend, and hold harmless KinLink and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, your violation of any rights of a third party, or your violation of any applicable law.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service that cannot be resolved informally within 30 days of written notice shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may bring claims in small claims court for disputes within that court's jurisdiction. The arbitration shall take place in Los Angeles County, California, or via videoconference.
Class Action Waiver: You and KinLink agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration. If this waiver is found to be unenforceable, the entire arbitration agreement shall be void.
Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
These Terms are governed by and construed under the laws of the State of California, without regard to conflict of law principles. For disputes not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in Los Angeles County, California.
KinLink is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, internet outages, third-party service failures, government actions, or labor disputes.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice, except for immediate termination in cases involving fraud, abuse, or legal compliance.
Guardians may delete their account at any time from within the app. Deleting a Guardian account deletes the family record, including Dependent profiles and their data, as described in the Privacy Policy. Guardians may also remove an individual Dependent at any time from within the app.
Because Dependent profiles exist inside a Guardian's family record, a minor Dependent cannot unilaterally delete the family record or unpair. This is an intentional safety design, consistent with how child accounts work in family-sharing services generally. Any Dependent can stop location collection through their device settings at any time, and any Dependent who believes the Service is being used against them in violation of Section 4 can contact support@kinlinkapp.com; we can investigate and unpair connections where appropriate.
Upon termination, your right to use the Service ceases immediately, and we handle your data as described in our Privacy Policy.
We may update these Terms from time to time. For material changes, we will notify you by email or in-app notice at least 30 days before the new terms take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
